Due to recent COVID restrictions, the Hamburg Town Court will NOT be in regular session. All Criminal, Small Claim/Civil matters are suspended until further notice. Once Court is authorized to resume, you will be contacted by the Court via the mail for a future date. You will not be penalized for your absence.
For all TRAFFIC TICKET INFRACTION(S) the appearance date you received by the Police Department is not your actual Court date. If you received a traffic ticket, please enter your plea, and return the ticket to the Court office via the US mail. If you plead not guilty you will receive a Plea Waiver in the mail from the Town Prosecutor. Please allow 4-6 weeks for the Court to process your plea.
The Court Clerk’s Office is open to the public, but with limited access, if you wish to pay a fine, it is encouraged to either pay online at paycourtonline.com or mail a money order or certified check to the Court.

Live Well Erie has up to $3,500/household rental and mortgage assistance available for qualified households (85% of NYS Median Income).
This program is available to income qualified (200% of federal poverty) Erie County Residents that have experienced a loss of income due to the COVID-19 pandemic and have fallen behind on their rent or mortgage as a result. Applicants will also receive 4 months of budget coaching to ensure that they are equipped to remain in their housing for the long-term. Residents find employment in industrial and service industries within the Town and Metropolitan Buffalo. Police and fire protection, along with highway, sanitation, recreation, sewage services and facilities, are provided for the area by the Town or special districts under the supervision of the Town Board. The Villages of Blasdell and Hamburg are contained within the Town's boundaries.
Minutes away from Hamburg, you have Canada and Niagara Falls to the North; winery tours, Amish Country and the Chautauqua Institute to the South; ski resorts and amusement parks to the East and over 9,000 square miles of fishing, boating and water sports to the west. New York State passes the COVID-19 Emergency Eviction & Foreclosure Act of 2020 (12/28/2020)
The Act prevents residential evictions, foreclosure proceedings, credit discrimination and negative credit reporting related to the COVID-19 pandemic. It also extends the Senior Citizens' Homeowner Exemption and Disabled Homeowner Exemption from 2020 to 2021. The Act adds to New York State's efforts to protect tenants and homeowners from the economic hardship incurred as a result of the COVID-19 pandemic. Residential Evictions: The Act places a moratorium on residential evictions until May 1, 2021 for tenants who have endured COVID-related hardship. Tenants must submit a hardship declaration, or a document explaining the source of the hardship, to prevent evictions. Landlords can evict tenants that are creating safety or health hazards for other tenants, and those tenants who do not submit hardship declarations. Residential Foreclosure Proceedings: The Act also places a moratorium on residential foreclosure proceedings until May 1, 2021. Homeowners and small landlords who own 10 or fewer residential dwellings can file hardship declarations with their mortgage lender, other foreclosing party or a court that would prevent a foreclosure. Tax Lien Sales: The Act prevents local governments from engaging in a tax lien sale or a tax foreclosure until at least May 1, 2021. Payments due to the locality are still due. Credit Discrimination and Negative Credit Reporting: Lending institutions are prohibited from discriminating against a property owner seeking credit because the property owner has been granted a stay of mortgage foreclosure proceedings, tax foreclosure proceedings or tax lien sales. They are also prohibited from discriminating because the owner is in arrears and has filed a hardship declaration with the lender. See the NYS Unified Court System Hardship Declaration Below:
The US Center for Disease Control (CDC) issued a federal eviction moratorium for all renters at risk of being evicted to help prevent the spread of coronavirus. The moratorium went into effect September 4, 2020 and lasts through MARCH 31, 2021. The order applies to states and territories with reported cases of coronavirus. Qualified renters must provide a signed declaration to their landlord (see form below). If able to pay rent, you must still do so.
