New York State has the Safe Harbor Act for eviction restrictions.
See below for further information:
The Tenant Safe Harbor Act provides protection from eviction for renters who have experienced financial hardship during the COVID-19 State of Emergency. The legislation prohibits courts from ever evicting residential tenants who experienced financial hardship for non-payment of rent that accrues or becomes due during the COVID-19 period. It would apply to any unpaid rent accrued between March 7 and the yet-to-be-determined date on which all COVID-related restrictions on non-essential gatherings and businesses are lifted.
The Department of Community Development has contracted with the Center for Elder Law & Justice as well as Neighborhood Legal Services to provide legal assistance to residents dealing with evictions during this pandemic. Call our office for further information (716) 648 - 6216.
The Centers for Disease Control issued a federal eviction moratorium for all renters at risk of being evicted to help prevent the spread of coronavirus. The moratorium went into effect September 4, 2020 and lasts through December 31, 2020. The order applies to states and territories with reported cases of coronavirus. Qualified renters must provide a signed declaration to their landlord (see form below). If able to pay rent, you must still do so. Renters can still be evicted for the following reasons: (1) conducting criminal activity on the property; (2) damaging the property; (3) violating building codes, health ordinances; and (4) violating the rental contract (other than the timely payment of rent, late fees, etc.).
